These Terms of Service govern your access to and use of StrokeLab, a swim video analysis service provided by Swimmetrix. Please read them before using the service.
1.Acceptance
By accessing or using StrokeLab, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service. If you use StrokeLab for a club, school, employer, or other organization, you represent that you have authority to accept these Terms for that organization.
2.The service
StrokeLab lets users review race video in their browser, mark race events, calculate swim metrics, save or sync supported analysis data, compare performances, export reports, and use related coaching features. The original video is processed locally in the browser and is not uploaded by StrokeLab. Features may differ by account, device, location, or release.
3.Eligibility
You must be legally able to agree to these Terms. A user under 13 may not create an account or submit personal information without permission and supervision from a parent or legal guardian. Coaches, teams, and guardians are responsible for obtaining any permissions required before entering or sharing information about swimmers.
4.Accounts
Google sign-in is optional. You are responsible for keeping your Google account secure, for activity performed through your account, and for providing accurate information. Tell us promptly if you believe your account or synced StrokeLab data has been accessed without permission. We may limit account functionality when necessary to protect users or the service.
5.Your content and data
You keep ownership of video, timing marks, notes, analysis data, and other content you provide. You give Swimmetrix a limited license to host, process, reproduce, and transmit account-linked analysis data only as needed to operate, secure, maintain, and support the features you choose to use.
You represent that you have the right to use the video and data you provide, including any footage or information concerning another person. Do not upload, enter, or share content that violates privacy, publicity, intellectual-property, or other rights.
Browser data can be erased by browser settings, device failure, or software changes. Keep your own copies of important exports and source video.
6.Acceptable use
You may not misuse StrokeLab. In particular, you may not:
break the law or violate another person's rights;
access another user's account or data without permission;
probe, disrupt, overload, bypass, or interfere with security or service operation;
upload malicious code or use automated systems that create unreasonable load;
reverse engineer protected parts of the service except where applicable law expressly permits it; or
use the service to harass, exploit, or endanger a swimmer or any other person.
7.Analysis limitations
StrokeLab is an analysis aid, not a timing authority, medical device, or substitute for qualified coaching, medical, or safety judgment.
Results depend on video quality, camera position, user marks, configuration, formulas, and software behavior. Outputs may be incomplete or inaccurate and should be checked before they are used for competition decisions, training loads, health decisions, or athlete safety. Stop activity and seek an appropriate qualified professional if health or safety is in question.
8.Third-party services
StrokeLab relies on services such as Google Firebase and content delivery networks, and may link to separate services such as Google sign-in. Third-party services are governed by their own terms and privacy policies. Swimmetrix does not control and is not responsible for their independent content, availability, or practices.
9.Our intellectual property
StrokeLab, its software, design, branding, text, and other service materials are owned by Swimmetrix or its licensors and are protected by applicable intellectual-property laws. These Terms give you a limited, personal, revocable, non-exclusive right to use the service as provided. They do not transfer ownership or permit you to copy, sell, sublicense, or commercially exploit protected service materials.
Feedback you voluntarily provide may be used without restriction or compensation, but it will not transfer ownership of your analysis data or video.
10.Changes and availability
We may add, change, suspend, or discontinue features, impose reasonable limits, or release updates. We do not guarantee that StrokeLab will always be available, error-free, compatible with every device, or that stored data will never be lost. When a material Terms change is made, we will update the date above and provide additional notice when reasonably appropriate.
11.Suspension and termination
You may stop using StrokeLab at any time and may request deletion of account-linked data as described in the Privacy Policy. We may suspend or terminate access when we reasonably believe these Terms have been violated, use creates risk or legal exposure, or suspension is necessary to protect users or service integrity. Provisions that logically need to survive termination will remain effective.
12.Disclaimers
To the fullest extent allowed by law, StrokeLab is provided “as is” and “as available.” Swimmetrix disclaims implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, and warranties arising from course of dealing or usage. Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.
13.Limits on liability
To the fullest extent allowed by law, Swimmetrix and its owners, personnel, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, revenue, profits, goodwill, or opportunities arising from StrokeLab. Swimmetrix's total liability for claims relating to the service will not exceed the greater of the amount you paid directly for StrokeLab during the 12 months before the event giving rise to the claim or US $100.
These limits do not apply where prohibited by law and do not limit liability that cannot legally be limited.
14.General terms
These Terms and the Privacy Policy are the entire agreement between you and Swimmetrix about StrokeLab. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganization, financing, merger, acquisition, or sale of assets. Applicable law and any mandatory consumer protections in your location continue to apply.
